From Thai Visa and Phuket Gazette.
Police arrest 12 on Ranong тАШvisa runтАЩ

RANONG: -- Twelve foreign tourists were pulled off a тАЬvisa runтАЭ bus just 40 miles from Ranong and confined to a jail cell overnight for overstaying their visas.

The company that arranged the tour claims that the arresting officers, from the Tourist Police and Highway Police, demanded 5,000 baht from each of the overstayed tourists in exchange for letting them go. The police strenuously deny this.

Six officers waved over the well-known тАЬBig BusтАЭ run by Phenpat Co Ltd at about 11 am yesterday morning in RanongтАЩs Kapoe District. The officers inspected the passports of the 34 foreign passengers and found that 12 had overstayed their visas.

They separated the 12 from the others, who were allowed to continue on to Ranong. The 12 were taken off in a police truck and confined in the local police cells.

Jutarat Payonchart, an emplo yee of Phenpat Co Ltd, told the Gazette from the Ranong courthouse this afternoon that the police had overreacted by incarcerating the visa runners.

тАЬWhy did they have to keep them overnight in a cell? These arenтАЩt illegal aliens trying to hide out in the country,тАЭ she asked, adding that most were just one- or two-day overstays. The maximum overstay was just 12 days, she added.

K. Jutharat said she was preparing to pay fines for those who had not brought along enough money to cover the unexpected expense тАУ but by 5:30 pm the following day they were still at Ranong Provincial Court trying to pay the fines.

One of those arrested, a 31-year-old Australian man whose 30-day tourist visa expired the day before, told the Gazette: тАЬIt was terrible. I am so dirty now тАУ I need to change my clothes. We didnтАЩt have any information.

тАЬIt was crap. The pol ice are hospitable in a way, but they donтАЩt give us any information. They say we broke the law and all this stuff.

тАЬIn my case, on Tuesday I went to [Phuket] Immigration and said, тАШThis is the last day of my visa, it expires tomorrow, what should I do?тАЩ and they said, тАШGo and do a visa run tomorrow and pay a 200 baht overstay.тАЩ

тАЬThatтАЩs exactly what I [was doing], but then we get pulled over by the Tourist Police and Highway Police and they make a huge problem for us,тАЭ he said.

He added that he found it dangerous and embarrassing to be forced to squat in the back of a cramped, hot police truck, which transported the overstayers along the highway with a police escort, sirens blaring.

The unexpected delay had also caused him to missed his flight out of the country, he said.

Pol Maj Songproad Sirikul, the new head of the Ranong Tourist Po lice, told the Gazette that his office had received a report that a business was assisting illegal aliens by bringing them to Burma. He said he ordered his men to check into this and, when they did, it turned out to be true.

тАЬThe police arrested them because they broke the law,тАЭ he said.

He denied K. JutaratтАЩs claims that the officers asked for 5,000 baht from each tourist in exchange for letting them go.

тАЬI think thatтАЩs impossible. I can guarantee that the Tourist Police officers did not ask for money because we are not in trouble [financially] and I constantly remind them to not do that.

тАЬIf the visa runners have any witnesses or other evidence as to which officer asked for money, they should contact me direct,тАЭ he said.

I have heard many stories over the years of problems with overstays..If you are on overstay, you are very vunerable and are illegally in the country..The reality is that the vast majority of the time, you will have no problem and just pay 200B. for each overstay day when you leave..
However, there is a small chance you will get caught and then you have a real headache..
Stopping a visa run is obviously a fool proof way to catch overstayers..I would have paid the bribe to avoid the jail experience and perhaps losing your ablility to get a new visa for years,or even for life..

Many persons are avoiding all troubles and just going to Malaysia for things like language school, medication classes, teaching, a vacation by the beach, scuba (water) sports ... (but certainly not foir the 'life'). Most nationals get 90 days visa free in Malaysia. That's certainly a draw down there.

Thanks for your story Boxer, before i was thinking overstays are a simple 200 bath problem. Now i see you can get in jail. I never stay to long in Thailand but mostly i go out Thailand the day before my visa expires. Mostly i use a 60 days visa for traveling in Thailand, i get it from the Thai embassy in Belgium. But a good warning if i ever like to stay some more days. Thanks Boxer.

It boils down to this:

1. If you overstay and can make it to the border Immigration counter without getting caught, you pay 200 B per day you overstayed and get off.

2. If you overstay and they catch you ANYWHERE IN THE COUNTRY, they will arrest you and put you in Immigration jail, and you still have to pay 200 B per day you overstayed before they deport you.

At least you can relax in Malaysia. The weather is best aroung Dec-Feb and you avoid swarms of high season tourists, even in years as bad as this.

It would look good to get a picture in the jail with handcuffs and leg irons on.Imagine showing that to all the blokes at work.

Yea, you go ahead and show them a picture of yourself in a Thai jail. Then the blokes will say: Visa overstay? No, you are a child molester!

Good luck

Nobody mentions the obvious. Some cops, ever in need of some scam to boost their appalling wages and perhaps tired of stopping un helmeted farang bike riders, came up with the brilliant idea of stopping a visa run bus. Typical customers of such a bus are the complacent, the disorganised and sometimes the serial illegal. Rich pickings and notice the fee (5000 baht), was pitched just right to enable the scammed to pay up promptly.
I agree with everything said above about the dangers of overstay, but Thai regulars must always factor in the dubious role the Thai police have in being able to totally mess up a farangs life.

Immigration national computer network discussed at Hard Rock meeting.

At the Hard Rock Hotel Pattaya, a meeting of Immigration Police, led by Police Colonel Pongdaert, Deputy Commander of the National Immigration Bureau took place. Police Colonel Itipon, the Chief of PattayaтАЩs Immigration Bureau attended along with his officers and other immigration officers from around Thailand. They discussed a new national computer network which has begun to better locate foreigners should they need to be tracked down for any reason. This training seminar went through the main points of the network and how it can assist the Immigration Bureau in identification and location of foreigners. This should reduce the numbers of foreigners who reside in the Kingdom of Thailand with an expired visa, either intentionally or by mistake.
