Pornographic CD vendor arrested in South Pattaya.

The production and distribution of pornography is illegal here in Thailand and here in Pattaya the sale of sex CDтАЩs is a thriving business with teams of CD sellers who tour the city on foot and on motorbikes searching for tourists who may be interested in purchasing these illegal items. PattayaтАЩs Tourist Police Division along with other local Police departments are committed to eradicating this practice and on Wednesday night a group of undercover Tourist Police Officers conducted an operation in Soi Sunee Plaza, South Pattaya and caught one man, Khun Somshai aged 28 who was found to be in possession of 61 sex VCDтАЩs, including a home movie featuring a popular Thai actress known as Anna which was stolen from her home and is now being sold around Thailand. Khun Somshai purchased the CDтАЩs for 30 Baht each from Silom in Bangkok and sold them for up to 150 Baht each. He was charged with selling pornographic material and is now in the hands of the Pattaya Provincial Court who will decide his fate.

No.

It is just a friendly alert to people that if you are offered a photo opportunity with a cute looking freelancer you will be far better off declining it rather than be caught up in yet another new scam that is doing the rounds and will cost you dearly.

I have said privately to a member of this forum that I fear these scams are becoming more desperate and only hope that the victim suffers no more than financially.

I have to give them points for creative scamming. First they encourage a farang to make home made porn with this boy, and then they bust him? Yikes! :confused2:

does anyone known the actual law? because I was under the impression that while the distribution of porn was illegal it was not illegal to possess porn or produce porn - unless there was evidence of distribution.

I have NEVER heard tell of anyone in Thailand being arrested for possession of pornography.
Also never heard of a foreigner being blacklisted for that.
So even if it is on the books, is it really ever prosecuted?
Remember, PROSTITUTION is also illegal in Thailand!

That said, if you were subject to a search and they found porno, this would certainly not be a factor in your favor.

It is a good idea to avoid having photos or videos of Thai friends when going through customs, even if the pictures are innocent (or at least legal in your home country).

Suspicious farang customs officers are not used to how Thais look and you can get problems explaining that your Thai friend is a 20something if customs thinks he is underage. To the untrained eye a young adult Thai can easily look underage. If customs thinks he is too young and you can't prove he is not, you risk being accused of sex crimes abroad or of making "child pornography".

Even if you get out of it eventually this is bound to be an unpleasant experience.

The law as I understand it is that pornography possession is not illegal, but distribution is. The lack of illegality for possession apparently also extends to child pornography, which of course is deplorable.

However, 'pornography' and 'distribution' are open to strange interpretations - for example the recent ludicrous "Thai Guys" case (I won't mention the names of those involved). In that case the farang proprietors of a travel agency were deemed to be involved in the distribution of pornography because they had copies of the free Thai Guys magazine in their office, which they did not publish, but which customers could take away.

If Thai Guys can be deemed pornography, and use of the internet could conceivably be interpreted by the Thai courts as evidence of possible distribution, then many of us could fall foul of such a law s someone wanted to make an example. In the case mentioned, it was the embassy of the gentleman in question that apparantly passed his name to the Thai authorities.

As regards to the Thai Guys case-common ex-pat gossip at the time was that this was a case of conservative elements of Australian policing authorities based in Thailand who were always out to get a group of ex-diplomats for a variety of reasons and whether guilty of anything or not.

To their credit the current conservative government in Oz had investigated these guys and declared this was nothing in it but we know rogue elements in the police in any country can still wield power. That case was definitely an anti-gay travesty of justice and these police thugs have pursued the man upon his return to Sydney. Further gossip is that the same officers have been told to pull their heads in by powerful members of government who can smell the brewing's of an almighty scandal.

The only way to avoid any hassle is to stay completely within the law as corruption is not confined to local law enforcement.

I have a copy of her movie (three different scenes) courtesy of a Thai mailing list I got on some how. Her BF is quite nice looking - which is why I kept the download - but I didn't realize she was a famous actress. I just wish they had invited a 3rd person to be the cameraman, as Mr.BF keeps jumping up to fuss with the camera. Anybody else see it?
